Agreement to Terms

By accessing or using Ayra Talk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information that results from your use of our web pages.

Service Description

Ayra Talk is a free Augmentative and Alternative Communication (AAC) application designed to assist individuals with communication disabilities, including but not limited to autism spectrum disorder.

The Service includes:

A visual communication interface with customizable symbols and pictures
Text-to-speech functionality
Customizable communication boards
Accessibility features for various needs
Web and mobile applications

User Accounts

When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

Acceptable Use

You agree not to use the Service:

In any way that violates any applicable national or international law or regulation
To exploit, harm, or attempt to exploit or harm minors in any way by exposing them to inappropriate content or otherwise
To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
To impersonate or attempt to impersonate Ayra Talk, an Ayra Talk employee, another user, or any other person or entity
In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Ayra Talk and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Ayra Talk.

Certain components of the Service may be licensed under open source licenses. Information about these components and their respective licenses is available within the application or upon request.

User Content

Our Service allows you to upload, store, and share content such as photos, symbols, and custom communication boards ("User Content"). You retain all rights to your User Content.

By uploading User Content, you grant Ayra Talk a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content solely for the purpose of operating, promoting, and improving our Service.

You represent and warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to your User Content; and (ii) your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

Service Availability

We strive to ensure that the Service is available 24/7. However, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Ayra Talk, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Ayra Talk has been advised of the possibility of such damage.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Ayra Talk, its subsidiaries, affiliates, and its licensors do not warrant that:

The Service will function uninterrupted, secure, or available at any particular time or location
Any errors or defects will be corrected
The Service is free of viruses or other harmful components
The results of using the Service will meet your requirements

Governing Law

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
